If you are an employee, you should know that you will be able to take leave to take care of the sick child until the child turns 12.
Until now, for reference, the law said that if you wanted this type of leave, the child had to be up to seven years old.
Therefore, according to GEO 158/2005 on social health insurance leaves and allowances, employees who have an insurance period of at least six months in the last 12 months can request medical leave and the allowance for caring for a sick child. The leave and the allowance are granted until the child is seven years old or until the age of 18 for the disabled child, for intercurrent conditions. And in the case of a child with serious conditions, the right is granted until he turns 18.
Leave for caring for a sick child
But now, the draft law adopted yesterday by the Chamber of Deputies with the final vote will intervene, however, only in the standard leave period – it will be extended from the age of seven to the age of 12. It is important to mention, of course, that the legislative proposal must be promulgated by presidential decree and published in the Official Gazette in order to apply, writes Avocatnet.ro.
Thus, those who passed this bill recorded that a sick child over the age of seven cannot be left alone at home to care for himself or administer his own medication. The minimum age from which a child can be left alone at home (and in that case only for a few hours) is 12 years old, according to psychologists.
The provisions of GEO 158/2005 regarding medical leave for the care of a sick child:
- to be requested, the employee must have contributed to the public health system for at least six months in the last 12 months;
- the monthly gross amount of the allowance is 85% of the calculation base (average gross monthly income during the internship period);
- the allowance, which is borne entirely from the state budget, can only be granted to one of the parents, not to both parents;
- leave is granted, in principle, for 45 calendar days per year (but in certain situations the period can be longer).
