From autumn 2024, the sale of a car in Romania, registered or not, will only be done with a RAR Auto-Pass certificate, which will provide clear information about the vehicle’s history.
Law 142/2023 (regarding the electronic register of the history of road vehicles registered or registered in Romania) was promulgated by President Klaus Iohannis and published in the Official Gazette on May 26.
According to the law, article 1, the Autonomous Directorate “Romanian Car Registry” hereinafter referred to as RAR, establishes and manages the electronic registry of the history of road vehicles registered or registered in Romania.
Article 2 provides that the “Register” is made up of the information obtained by RAR on the occasion of the services provided by RAR that involve the identification of the road vehicle, or on the occasion of carrying out the periodic technical inspection within the RAR representative offices or the periodic technical inspection stations authorized according to the legislation in force , from the information sent to RAR by the workshops for the inspection of tachographs and/or speed limiters authorized according to the legislation in force, from the information sent to RAR by the economic operators authorized according to the legislation in force who carry out repair, maintenance and functional adjustment activities, of constructive modifications and reconstruction of road vehicles, hereinafter referred to as authorized economic operators, as well as from the information sent to RAR by road vehicle manufacturers, their authorized representatives, importers or distributors of new road vehicles.
Article 9 provides that, upon disposal of a road vehicle registered, registered or introduced on the market in Romania, the person who disposes of the road vehicle shall deliver to the acquirer a valid “RAR Auto-Pass” certificate for the road vehicle subject to disposal. If no information about the road vehicle in question is available in the register, instead of the “RAR AutoPass” certificate, RAR will issue a document stating this situation free of charge.
The “RAR Auto-Pass” certificate is valid for 60 days from the date of its issuance.
RAR will issue a certificate called “RAR Auto-Pass” containing the information in the register regarding to the history of the odometer reading, the involvement of the road vehicle in an event that caused serious damage to the steering system, the braking system, the resistance structure of the body or chassis or to other active or passive safety systems, as well as to the non-appearance of the road vehicle as part of a recall campaign.
According to article 14 of law 142/2023, paragraph 1, the information provided in art. 3 – 6 will be transmitted through a specific computer application provided by RAR within one year from the date of entry into force of this law.
The provisions of article 9 apply from 6 months after the deadline provided for in paragraph 1.
