The general assemblies of prosecutors from different structures decided, in Wednesday’s meetings, to demand the adoption of a real system of phasing the standard retirement age, which would avoid dysfunctions and inequities in the judicial system, while ensuring predictability, reports News.ro.
“The general meetings of the prosecutors from the Prosecutor’s Office attached to the High Court of Cassation and Justice, the National Anti-Corruption Directorate and the Directorate for the Investigation of Organized Crime and Terrorism, met on 31.05.2022, at the convening of the Plenary of the Superior Council of Magistracy, adopted the point of view formulated in the sense of “the need to adopt a real system of phasing the standard retirement age, which avoids dysfunctions and inequities in the judicial system, with the assurance of predictability and respect for the constitutional status of magistrates”, the Public Ministry transmitted on Wednesday , in a press release.
According to the cited document, the point of view expressed in the General Assemblies of prosecutors represents “an expression of deep concern generated by the proposals to amend Law no. 303/2022 on the status of judges and prosecutors”.
The prosecutors also accuse a “total lack of transparency in the decision-making process and no prior consultation of the representatives of the judicial system, despite the constant call for dialogue, expressed including by the Plenary Decision of the Superior Council of the Magistracy no. 90 of 25.05.2022”.
“It was shown that, in the adoption of the regulations in this field, the institution of any future discrimination between service pension beneficiaries must be avoided, the method of phasing the retirement age currently proposed having as a direct consequence the creation of immediate discrimination between magistrates, by imposing a similar condition of age for most of them, without any real differentiation in relation to seniority in the magistracy accumulated up to this moment”, the document also states.
According to the prosecutors, at the same time, “the untimely application and without any prior impact study of these changes has the ability to create major dysfunctions in the judicial system, both by the immediate retirement of a significant number of judges and prosecutors, and by severely affecting the ability to attract new magistrates to the profession, with the risk of serious, long-term consequences for the proper functioning of the judicial system, burdened anyway by an unprecedented personnel crisis”.
“Therefore, it appears imperative to initiate immediate consultations with the representatives of the judicial system, in order to adopt a real, transparent and predictable system of phasing the standard retirement age, which avoids dysfunctions and inequities in the judicial system, respecting the constitutional status of magistrates and the obligations assumed within the Rule of Law Mechanism”, the prosecutors also sent.
The National Union of the DICASTERIAL Judicial Registry announced on Tuesday that it will join the protests started by the other categories of employees in the budgetary system and claims that the clerks have the “necessary capacity” to block the judicial system.
The president of the PSD, Marcel Ciolacu, declared on Wednesday that the special pensions law should also apply to the pensions that are being paid, otherwise there can be no reform.
