USR and Forța Dreptei attacked, on Tuesday, at the CCR the amendments made by the PSD parliamentarians to the Civil Code regarding the lease regime, regulations that affect the right to private property, according to the parliamentarians of the two formations.
The legislative proposal that is the subject of the notification to the CCR establishes a mandatory minimum period of 7 years for lease contracts, a condition without which any contracts are to be declared illegal, according to a press release issued by Forța Dreptei. This represents a restriction of the exercise of the right of ownership in the sense that those who own properties that they wish to lease will no longer be able to decide in relation to that property, from year to year, depending on the benefits obtained.
“It is also inadmissible to impose as an effect of the 7-year term a right of pre-emption for the purchase of land during the same period, as well as allowing the exchange of land between tenants, without the condition of the owner’s agreement.
Moreover, through the effect of this law, the agricultural market will be blocked to new farmers who will want to lease land, the consequence being an even greater concentration of agricultural land in the hands of the red landowners.
We find with disappointment the fact that such a regulation, deeply anti-liberal, could only be adopted with the majority vote of the PNL parliamentarians, both in the Senate and in the Chamber of Deputies”, the quoted source added.
According to the elected members of the Opposition, the referral to the Constitutional Court considers the violation of the constitutional provisions related to private property and its regime, the principle of equality of rights and equality before the law, the principle of economic freedom and the contractual freedom of the parties, as well as the principle regarding to the proportionality of the regulations that restrict fundamental rights and the rigors imposed by the provisions of the Constitution regarding the rule of law.
“The legislative project is a continuation of the way of action of the communists, being a harmful and unprofessionally designed law, which affects the fundamental right of Romanians to dispose of the lands they acquired through their own work or inheritance.
«The project in question totally ignores the principle of contractual freedom, without providing any solid justification. Behind this law is undoubtedly PSD-ist baron Paul Stănescu from Olt”, declared Silviu Dehelean, USR deputy.
In combination with Law 17/2014, this new bill seems to aim to concentrate power in the agricultural field in the hands of a small number of tenants – large owners, whether Romanian or foreign, leaving the rightful owners at their discretion.
“PSD not only gives birth to a harmful law, but it does not even demonstrate the competence to draft it correctly – it is unclear, presents legislative parallels and violates, without any embarrassment, the law on legislative technique”, explains deputy Silviu Dehelean”, says a USR release.
USR calls on PSD to stop the continuous violation of the rights and freedoms of Romanians.
